Good morning Mr. Dean Rodia,

Hope everything is well with you.

Please excuse us if you find this email in your mail box unexpectedly.

Please allow me to introduce to you that my husband, Tinh Cao and I are the owners of the property locates at 12173 Highgate Ct/Dr., in the city of Rancho Cucamonga.

We're having some problem resulted from that big tree in front of our house, on the outside of the sidewalk. The tree was planted there when our new tract home were built in the year 2000, as part of the City requirement. We believe the roots of this 18 years old tree have been damaged the sidewalk (curved up and uneven) and the main water pipeline next to the tree (water has been leaking and not drained) for few years now. Also, its heavy/big branches felt during the Santa Ana wind (happened last Oct) which could damaging any car park next to the tree or even hurt people if they happen to be near by. Please see some pictures in the separate email.

Last Thursday Jan 10, 2019, I went to the City Hall and inquiring information. I spoke to a gentlemen at the front counter of Engineer Section/Division about the problem. He searches in the data base/computer to find out if the tree is on the City property or in our property. He concluded that the tree is in the City property line. He told me that I need to speak to Public Work Dept. and gave me your business card and advise me to call you.

I then called your office hoping that I can speak with you regarding that big tree's problems. You could not be reached; therefore, I left you a voicemail.

At 4:41 pm of same afternoon (Thursday Jan 10), Mr. Lucas Mitchell from your office returned my call. He told me that he will have his staff to come to our property to do inspection on Monday (Jan 14) or Tuesday (Jan 15) this week, since the City does not work on the weekend including Friday. He said when the worker comes to inspect, he/she will knock on our door but we do not need to be home. After inspection, he/she will write the report and his office (your office?) will email us what your finding and or what the City will do. However, I asked Mr. Mitchell that we want to speak with the worker so we can show him/her the damages. I also left a note next to the tree (it's still there).

Yesterday morning (Monday Jan 14), I called Mr. Mitchell back and again requested that he let his worker know to speak with us when he/she come to do inspection. He confirmed that the inspection was scheduled for yesterday (Monday Jan 14). I asked when can I expect the report or an email; his response was either this evening or tomorrow morning (which means this morning). Till now, we haven't see (speak to) any inspector came to the property nor any email/report.

We are writing you to ask you kindly let me know whether or not the inspection has been performed? Please let us know when the City will remove the tree (because its wide spread roots will continue damaging not only the sidewalk, our main water pipeline but soon perhaps including the parking entry or the house entrance). We asked and hope that the City take care of this problem ASAP for its citizens, specially senior. Each year we're paying too much taxes for Rancho Cucamonga Landscape District, through property taxes.

My husband and I want to express our thanks to you for your prompt response to our email.

We also would like to thank your staff, Lucas and his team, for coming our to inspect the problem.

From your email we understood the following:

1/ The removal of the tree has been scheduled to be performed in 90-120 days depending on schedule and availability of your tree maintenance contractor.

2/ The sidewalk is lifting will be reviewed by our Street Division and they will determine what will be done with the sidewalk.

3/ The water leak is the residents responsibility to repair and prevent the leak from continuing. At this time, without exposing the water leak problem, determining if the tree had any impact or cause is not possible.

Now for # 1: We have a big favor to ask from you. Can the removal of the tree be done sooner, like next month or within 30 days, if possible? The reason for this is because we will have the "Pre-wedding ceremony" for our daughter at our house on May 4, 2019. And, to prepare for this important event, we are redo the landscape on our house (both front and back yard). The work include replacing the existing old grass between the sidewalk and the street (which also surrounding the subject tree) by turf. This project is scheduled to start the 2nd week of February. By removing the tree first, the landscape crew can do all their work together. Please understand the situation and do your best to accommodate our request.

For # 2: Will the Street Division inform/contact us about their finding, decision and scheduling? Or will your office do that?

For # 3: We will contact CVWD, as you advise.

I just wanted to let you know that I followed up with my Urban Forestry Team and got an update on the tree situation at 12173 Highgate Dr. The tree and the surrounding area was inspected on January 14^th and a series of updated photos were taken at that time. It does appear that the tree has had some structural damage and was installed, by the housing developer, too close to the water meter. The inspection results recommends the removal of the tree based upon the structural integrity of the tree, very limited growing area and utility location. The removal has been scheduled to be performed in 90-120 days depending on schedule and availability of our tree maintenance contractor. The fact that the sidewalk is lifting will be reviewed by our Street Division and they will determine what will be done with the sidewalk. The water leak is the residents responsibility to repair and prevent the leak from continuing. You can contact Cucamonga Valley Water District (CVWD) and they can guide you through the process, since they own the meter and service the water lines. At this time, without exposing the water leak problem, determining if the tree had any impact or cause is not possible. I do recommend that you get the leak fixed soon so you can save water and reduce your bill.

Nhưng thực tế cho thấy cái rễ của nó càng làm cho đường đi (sidewalk) bị nhô lên khi rễ cây ngầm dưới đây vươn dài nở rộng khi cây càng lớn càng cao

- đó là trở ngại thứ 1;

Cái trở ngại thứ 2 là từ cửa nhà nhìn ra bị chắn mắt và nhà bị che mặt từ ngoài nhìn vô;

cái trở ngại thứ 3 là bất ngờ cành cây bị gẫy gây nguy hiểm cho xe hay người ở gần vào lúc ấy;

cái trở ngại thứ 4 là rễ của cây làm cho ống nước ở ngay meter chính bị rò rỉ khiến nước cứ chảy dọc theo lề đường,

City đã được gọi tới check nhưng bảo rằng chủ nhà phải sửa bởi cái lỗ rĩ nước thuộc về phần ống nước bên phía trong meter.

Do đó, để có thể bắt đầu việc canh tân lại cả vườn sau lẫn vườn trước nhà, trước Tết VN 5/2/2019 và trước Đám Hỏi của Thiên Sa (5/2019) và đám cưới (11/2019)

má đã phải ra tận city hall khiếu nại và xin city hạ cây này xuống, với những tấm hình chụp chứng thực 4 trở ngại (nhất là 1,3 và 4) gây ra cho ngôi nhà của GĐCB.
